Terms of Service for Matchbook App

These Terms of Service (“Terms”) govern your use of the Matchbook App (the “App”), owned and operated by Ruaridh Maclean (“we,” “us,” or “our”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

1. Description of the App

Matchbook is a dating tracking and journaling application that allows users to document their dating experiences, journal entries, and related information. The App is available on iOS devices and offers both free and subscription-based features.

2. Eligibility

You must be at least 16 years old to use the App. By using the App, you represent that you meet this age requirement and have the legal capacity to enter into this agreement.

3. Subscriptions and Payments

  1. Pro Subscription: The App offers premium features through a Pro subscription.

  2. Payments: Subscriptions are billed through your Apple ID account. All transactions are subject to Apple’s payment terms.

  3. Free Trial: If applicable, a free trial may be offered. If not canceled before the trial ends, you will be automatically billed for the subscription.

  4. Cancellations: You can manage or cancel subscriptions through your Apple ID account.

4. User Content

  1. Ownership: You retain ownership of the content you upload or create within the App, including profiles, chapters, and journal entries (“User Content”).

  2. Backup and Storage:

    • Data is stored locally on your device by default.

    • If iCloud Backup is enabled, your data will be stored in your iCloud account, governed by Apple’s iCloud terms.

  3. Responsibility: You are responsible for backing up your User Content. We are not liable for data loss due to device issues or your failure to back up your data.

5. Analytics and Data Collection

We collect optional analytics data through Google Analytics, Firebase, SuperWall, and OneSignal to improve the App. You can opt out of analytics collection in the settings.

6. Intellectual Property

  1. App Content: All content, features, and functionality of the App (excluding User Content) are owned by us and are protected by copyright, and other intellectual property laws.

7. Prohibited Activities

You agree not to:

  1. Reverse-engineer or tamper with the App.

  2. Use the App for unlawful purposes.

  3. Circumvent in-app restrictions or subscription requirements.

  4. Share, distribute, or upload inappropriate, offensive, or illegal content.

8. Privacy

Your use of the App is governed by our Privacy Policy, which explains how we collect, use, and protect your data. By using the App, you agree to the terms outlined in the Privacy Policy.

9. Limitation of Liability

To the fullest extent permitted by law, we are not liable for:

  • Any indirect, incidental, or consequential damages arising from your use of the App.

  • Loss of data or content due to software or device issues, your failure to back up, or iCloud-related issues.

10. Modifications to the App

We reserve the right to modify or discontinue the App or its features at any time without notice.

11. Termination

We reserve the right to suspend or terminate your access to the App if you violate these Terms or engage in prohibited activities.

12. Governing Law

These Terms are governed by the laws of the United Kingdom. Disputes arising from these Terms will be resolved in UK courts.

13. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be available in the App, and your continued use constitutes acceptance of the changes.
